Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed that the Manager's name was not posted anywhere within the community care facility.
Corrective Action(s): Ensure that the Licence and the name of the Manager is posted in a prominent place in the community care facility.
Date to be Corrected: July 26, 2022.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon a review of one staff record, Licensing observed that the staff's character references have not been obtained.
Corrective Action(s): Ensure that staff records are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Upon a review of one staff record, Licensing observed that the staff's record of work history has not been obtained.
Corrective Action(s): Ensure that staff records are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon a review of one staff record, Licensing observed that the staff's certificate has not been verified through the Early Childhood Educator (ECE) registry.
Licensing provided education that all renewed certificates must be verified through the ECE registry.
Corrective Action(s): Ensure that staff records are complete.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: The Manager informed Licensing that children's wipes are used to clean and sanitize the diaper change mat between changing each child's diaper. At the end of the day the diaper change mat is cleaned using the bleach and water solution.
Licensing provided education that children's wipes does not sanitize the diaper change mat and that bleach and water solution needs to be used to sanitize the mat after each use.
Licensing provided only as a suggestion to have a separate bleach and water solution bottle for the bathroom and diaper change mat.
Corrective Action(s): Ensure that a program is established to instruct children in, and to practice the rules of health and hygiene.

Comments

Summary of Inspection
At the routine inspection conducted today July 26, 2022, there were three children, and the Manager present. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed.
The following education/recommendations were provided:
Volunteer; cannot be left alone with the children. File needs to be in place for the volunteer with specific documents.
CRC; required for ay staff working at the facility. Explained what a sharing form is.
Outdoor checks are required as there are some berries on the ground in the yard.
The contents of the inspection report were reviewed with the Manager at the time of the inspection. This report was written off site due to Covid-19 to help promote health and hygiene. A copy of this report and the risk assessment were emailed to the facility.
