Introduction

This is a unscheduled routine inspection to assess compliance with the Community Care and Assisted Living Act (C.C.A.L.A.), the Residential Care Regulation (R.C.R.) and the relevant Director of Licensing Standards of Practice (D.L.S.P.). Evidence for this report was based on the Licensing Officer's observations, review of the facility records, and information provided by the facility staff at the time of the inspection.

The following areas were reviewed:

- Medication
- Nutrition and Food Services

- Records and Reporting

As part of this routine inspection a facility risk assessment tool is completed and a copy is provided. The risk assessment includes non-compliance identified during the routine inspection, and a 3 year historical review of the facility's compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 32270 - RCR s.44(2) - A licensee who accommodates 50 or more persons in care in a community care facility must have, to supervise the preparation and delivery of food, a food services manager who is (a) a nutrition manager with membership in the Canadian Society of Nutrition Management, (b) a person who is eligible to be a member of the Canadian Society of Nutrition Management, or (c) a dietitian.
Observation: In discussion with the Food Services Manager and their Supervisor and then with the Director of Care, the Licensing Officer was advised of the following:

* The Food Services Manager is half way completed the program they are enrolled in to achieve their Canadian Society Nutrition Management.

* The Supervisor initially stated they are on-site 2 to 3 days and then stated they are on-site upto 4 days and the time period they are on-site varies (i.e., could be the whole day some days, but not other days).

* The Dietitian is on-site 3 days per week, but it is not confirmed if the Dietitian is aware they are responsible for supervising the preparation and delivery of food.
Corrective Action(s): Please provide a written response in a comprehensive format with responses to the following questions. As well, the Licensing Officer will review all the responses prior to making the determination that the intent of the legislation is being met. Please note: There needs to be adequate coverage for the supervision of preparation and delivery of food:

* Is the Dietitian responsible for the supervision of preparation and delivery of food the 3 days per week they are on-site? Is it reflected in the job description or some other means that the Dietitian is responsible for the supervision of preparation and delivery of food 3 days per week they are on-site?

* Is the Supervisor on-site on the days the Dietitian is not on-site? Is the Supervisor aware they are responsible for the supervision of preparation and delivery of food when they are on-site given the Food Services Manager does not yet have their Canadian Society of Nutrition Management (CSNM) and are not at the "eligible" for membership with CSNM? Please provide in-writing the number of days and hours the Supervisor is on-site.

The above are questions that need to be taken into consideration, unless the Licensee proposes a different plan to meet the intent of the legislation. If a different plan is submitted, it will be taken into consideration and reviewed first.
Date to be Corrected: May 20, 2022.

CARE AND/OR SUPERVISION: 34660 - RCR s.81(3)(d) - A care plan must include all of the following: (d) a recreation and leisure plan.
Observation: A review of the care planning system indicated that when clicking on point click care - Therapeutic Recreation Care Plan, it does not bring up a recreation care plan.
Corrective Action(s): Please ensure each person in care has a recreation care and leisure plan in-place. On May 16, 2022, the Director of Care stated in a response to this item that the Recreation staff is in the process of creating recreation care plans for each person in care and will be completed according to upcoming care conferences and the reviewed as necessary.

Staff personnel files/Volunteer files:
*The facility has implemented as of May 13, 2022 the Tuberculosis document from the Community Care Facilities Licensing TB and Immunization guideline for volunteers which meets the intent of the legislation.
Due to the Covid-19 pandemic, the findings were reviewed and discussed with the Director of Care at the time of the inspection. This inspection report, and risk assessment was written off-site and then emailed on May 31, 2022 to the Manager and Director of Care for review and to finalize the report and risk assessment once they were in agreement to the wording. As a result of the pandemic, signature for the Manager is not included. If there are further questions related to this routine inspection, please contact your Licensing Officer.
