Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- an uncovered electrical outlet in the naproom (corrected during the inspection)
- an unsecured blind cord in the naproom (corrected during the inspection)
- a charging cord on the floor in the naproom, along with an unsecured electrical cord (corrected during the inspection)
- the door to the furnace room is unlatched (corrected during the inspection)
- gate at the bottom of the stairs inside the facility is not in place (corrected during the inspection)
- broken bamboo lattice in the children's outdoor space located in the cedar hedge; which could pose a hazard as the broken bamboo is potentially at children's height and the size of the gaps may pose a potential risk of entrapment

Although children sleep in play pens in the nap room, there is potential that an older child could climb out of a play pen and access the above noted hazards, identified in the nap room.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed areas of damage on walls where the drywall is exposed. This does not allow for the area to be cleaned.
Corrective Action(s): Ensure that the community care facility is clean and in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The Licensee has not recieved a criminal record check for a staff.
Corrective Action(s): Ensure to obtain a criminal record check for each staff prior to employment.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Copies of any diplomas, certificates or other evidence of a staff's training and skills were not obtained.
Corrective Action(s): Ensure to obtain evidence of staff's training and skills prior to employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: An educator does not have certificate validation by the early childhood educator registry.
Corrective Action(s): Ensure to obtain certificate validation by the system maintained by the early childhood registry.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): At the time of Licensing's arrival, an ECE (replacing an IT Educator) and a Responsible Adult (replacing an ECE) were caring for 8 children. A Responsible Adult cannot replace an ECE. This was corrected near the end of the inspection when an IT Educator arrived.
Corrective Action(s): Ensure that the ratio of employees to children is no less than permitted in Schedule E.

Comments

During this inspection, the above noted contraventions were identified. As part of this Routine inspection, a Facility Risk Assessment Tool was completed.
The following was discussed during the inspection:
- strategies during transitions
The information contained in the report was discussed with the manager and the report and risk assessment were written off-site. Licensing emailed a copy of the report and the risk assessment to the facility.
