Report of Findings
On October 18, 2019, Licensing received a complaint alleging concerns regarding care and supervision .

The allegations included the following details:

- Inadequate care was provided to a person in care
- A person in care sustained injuries while in care
- Inadequate care plan for an aggressive person in care

All areas of the complaint were fully investigated. Evidence was received and reviewed from records, policies and procedures, inspection, interviews, and emails.

The following contraventions were determined:

- Community Care and Assisted Living Act Section 7((1)(b)(ii) Standards to be maintained
- Residential Care Regulation (RCR), Section 68 (4) Medication Safety Advisory Committee
- RCR 77 (2)(c) Reportable Incidents
- RCR 81(4)(b)(i) Care plan needed if more than 30 day stay
- RCR 82 Implementation of Care plans
- RCR 85(1)(d) Policies and Procedures
Substantiated Contraventions: Evidence for this summary report is based on a combination of the Licensing Officer’s observations, a review of facility records and information provided by the facility staff at the time of the investigation.
Observed Violations/Contraventions: A summary of the violations found during the complaint investigation are listed below.

32320 - RCR s.68(4)A licensee must ensure that all employees comply with the policies and procedures of the medication safety and advisory committee.
Observation: Staff did not follow MSCAC policies and procedures related to PRN use.
Corrective action: Corrective action plan in place.
33280 - RCR s.85(1)(d)A licensee must do all of the following: (d) ensure that policies are implemented by employees.
Observation: Staff did not follow facility polcies regarding assessments and documentation.

34750 - RCR s.81(4)(b)(i)A licensee must ensure that (b) each care plan is reviewed and, if necessary, modified (i) if there is a substantial change in the circumstances of the person in care.
Observation: A PIC care plan was not updated after a change in behaviour.
Corrective action: Corrective action plan in place.
34780 - RCR s.82A licensee must ensure that the care and supervision of a person in care is consistent with the terms and conditions of the person in care's care plan.
Observation: Staff did not follow the PIC’s care plan regarding challenging behaviours, including medication.

34950 - CCALA s.7(1)(b)(i)A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: A PIC with agressive behaviours was not provided the necessary asssement and support, leading to incidents of aggression and injuries to other PICs and staff
